Article R6323-10-4 of the French Labour Code

I.-The beneficiary of the professional transition leave provides the employer with supporting documents, drawn up by the training organisation, proving his/her attendance at the training course at the end of each month and when he/she returns to work.

An employee who, without legitimate reason, ceases to follow the training course, loses the benefit of the leave.

II.-By way of derogation, in companies with less than fifty employees, the beneficiary of the professional transition leave will submit the supporting documents proving his/her attendance to the regional inter-professional joint committee, which will provide the financial support for his/her professional transition project.

I.-Le bénéficiaire du congé de transition professionnelle remet à l’employeur des justificatifs, établis par l’organisme de formation, prouvant son assiduité à l’action de formation à la fin de chaque mois et lorsqu’il reprend son poste de travail.


Le salarié qui, sans motif légitime, cesse de suivre l’action de formation, perd le bénéfice du congé.


II.-Par dérogation, dans les entreprises de moins de cinquante salariés, le bénéficiaire du congé de transition professionnelle remet les justificatifs prouvant son assiduité à la commission paritaire interprofessionnelle régionale qui assure la prise en charge financière de son projet de transition professionnelle.
