If the ceilings are exceeded or if the objectives defined in Article D. 6332-18 are not achieved, the Minister responsible for vocational training will send the skills operator, by any means that provides a date certain upon receipt, a formal notice stating the reasons, in order to present, within a period of one month, its written and, where appropriate, oral observations justifying this situation.
In the light of the response from the skills operator or after this period has expired, the Minister responsible for vocational training may:
1° Issue a notice to the skills operator to take corrective measures to ensure compliance with the ceilings and targets defined in Article D. 6332-18. These measures must be followed up so that the response provided by the skills operator can be assessed;
2° Decide that the skills operator should pay the Treasury a sum corresponding in whole or in part to the amount of the overrun observed. Recovery of the payment is established and pursued in accordance with the procedures and subject to the securities, guarantees and penalties applicable to turnover taxes;
3° Appoint a provisional administrator within the skills operator;
4° Withdraw the approval of the skills operator.
