Article R6332-7 of the French Labour Code

When it is established that a skills operator no longer meets the conditions for approval set out in article R. 6332-4, the Minister responsible for vocational training will send it a formal notice stating the reasons, by any means that provides a date certain for receipt of this formal notice.

The skills operator has two months in which to present its written or oral observations.

In the light of the response from the skills operator or, where applicable, on expiry of this period, the Minister responsible for vocational training may withdraw approval by decree.

The order specifies the date on which the withdrawal takes effect, as well as the procedures for the devolution of the assets of the operator concerned. The operator is notified of the order and it is published in the Journal officiel de la République française.

Lorsqu’il constate qu’un opérateur de compétences ne satisfait plus les conditions d’agrément prévues à l’article R. 6332-4, le ministre chargé de la formation professionnelle lui adresse une mise en demeure motivée, par tout moyen donnant date certaine à la réception de cette mise en demeure.

L’opérateur de compétences dispose d’un délai de deux mois pour présenter ses observations écrites ou orales.

Au vu des éléments de réponse de l’opérateur de compétences ou, le cas échéant, à l’expiration de ce délai, le ministre chargé de la formation professionnelle peut retirer l’agrément par arrêté.

L’arrêté précise la date à laquelle le retrait prend effet, ainsi que les modalités de dévolution des biens de l’opérateur concerné. L’arrêté lui est notifié et fait l’objet d’une publication au Journal officiel de la République française.
