Article R643-5 of the French Commercial code

Creditors registered on behalf of a previous owner and holding a resale right or on behalf of the entrepreneur on an asset included in the assets in question as security for a claim affecting another asset shall be notified by the liquidator by registered letter with acknowledgement of receipt that they have an obligation to lodge their claim with the order procedure within two months of the notification. This notice shall reproduce the second and third paragraphs of this article.

The lodgement shall mention the security registered on the asset. A statement of the sums due in principal, interest and incidentals and the supporting documents shall be attached to the production.

Failing production within the period mentioned in the first paragraph, the creditor shall forfeit the right to participate in the distribution.

Les créanciers inscrits du chef d’un précédent propriétaire et titulaires d’un droit de suite ou du chef de l’entrepreneur sur un bien compris dans le patrimoine en cause en garantie d’une créance affectant un autre patrimoine sont avertis par le liquidateur par lettre recommandée avec demande d’avis de réception qu’ils ont l’obligation de produire leur créance à la procédure d’ordre dans le délai de deux mois à compter de l’avertissement. Cet avis reproduit les deuxième et troisième alinéas du présent article.

La production mentionne la sûreté inscrite sur le bien. Un décompte des sommes dues en principal, intérêts et accessoires et les documents justificatifs sont joints à la production.

A défaut de production dans le délai mentionné au premier alinéa, le créancier est déchu du droit de participer à la distribution.
