Article R711-38 of the French Commercial code

The draft master plan is adopted by the general meeting of the regional chamber of commerce and industry, by a two-thirds majority of its members in office, present or represented.

It is sent, along with the report mentioned in article R. 711-35, to the supervisory authority and to CCI France, within one month of its adoption.

If the master plan could not be adopted by the general assembly of the regional chamber of commerce and industry or was adopted without the provisions of this code having been complied with, the chamber of commerce and industry that does not meet the criteria set out in article R. 711-36 may be merged with a neighbouring chamber, or transformed into a local chamber of commerce and industry, by decree issued on the proposal of the minister responsible for overseeing the network of chambers of commerce and industry.

The revision of the master plan is carried out under the same conditions.

Le projet de schéma directeur est adopté par l’assemblée générale de la chambre de commerce et d’industrie de région, à la majorité des deux tiers de ses membres en exercice, présents ou représentés.

Il est transmis, accompagné du rapport mentionné à l’article R. 711-35, à l’autorité de tutelle et à CCI France, dans un délai d’un mois après son adoption.

Si le schéma directeur n’a pu être adopté par l’assemblée générale de la chambre de commerce et d’industrie de région ou a été adopté sans que les dispositions du présent code aient été respectées, la chambre de commerce et d’industrie qui ne répond pas aux critères fixés à l’article R. 711-36 peut être fusionnée avec une chambre limitrophe, ou transformée en chambre de commerce et d’industrie locale, par décret pris sur proposition du ministre chargé de la tutelle du réseau des chambres de commerce et d’industrie.

La révision du schéma directeur s’opère dans les mêmes conditions.
