I. – The modelling agency licence is refused or withdrawn by the Prefect referred to in article R. * 7123-9 :
1° When the applicant for the licence or the managers of the agency do not offer or no longer offer the necessary guarantees of good character. At any time, the administrative authority may request that a copy of Bulletin No. 2 of the criminal record or any document with equivalent effect be issued;
2° Where the legal or contractual provisions relating to the conditions of employment of models set out in Articles L. 7123-5, L. 7123-7 to L. 7123-9, and to the exercise of the activity of modelling agency set out in Articles L. 7123-14, L. 7123-15, L. 7123-17, L. 7123-19 and L. 7123-22, are not or are no longer complied with.
It is withdrawn if the provisions of article R. 7123-15 are not or are no longer complied with.
II – In an emergency, and where the modelling agency has committed a particularly serious irregularity, the Prefect referred to in article R. * 7123-9 may suspend the licence for a maximum period of one month.
III – Reasons must be given for the decision to withdraw the licence. It may not be pronounced without the interested party having first been informed, by registered letter with acknowledgement of receipt, of the reasons given in support of the proposed measure and invited to present his observations within a period determined by the Prefect.
IV – Orders refusing, suspending or withdrawing a licence are notified to the interested parties. Orders to withdraw a licence are published in the Journal officiel de la République française.
