The commission provided for in article L. 713-17, called the “election organisation commission”, competent to organise, in the district of the territorial chamber of commerce and industry, the elections of the members of the regional chamber of commerce and industry, the territorial chamber of commerce and industry and, where applicable, the delegations of the latter chamber, is chaired by the administrative authority mentioned in II of article R. 713-1 or his representative and comprises:
1° The president of the court of first instance with jurisdiction in commercial matters within whose jurisdiction the registered office of the territorial chamber of commerce and industry is located or his representative;
2° The president of the territorial chamber of commerce and industry or the presidents of the territorial chambers of commerce and industry when the election is made in the context of a territorial chamber of commerce and industry resulting from a merger. Each president may be represented by a member that he or she designates;
3° One member of the regional chamber of commerce and industry designated by the president of the latter.
The commission may appoint, on the decision of its president, as many members of staff as necessary.
The commission’s secretariat is provided by the director general of the territorial chamber of commerce and industry or, where the election is held in the context of a territorial chamber of commerce and industry resulting from a merger, by the directors general of the merged chambers or their representative appointed from the staff of their chamber. They may be assisted by a representative of the regional chamber of commerce and industry appointed by the latter’s director general.
For elections to local and departmental chambers of commerce and industry in Ile-de-France, on the proposal of the president of the regional chamber of commerce and industry, the regional prefect shall set up a commission at regional level. This committee is made up of the presidents of the courts of first instance with jurisdiction in commercial matters within whose jurisdiction the head offices of the chambers of commerce and industry concerned are located, and their president or representative. The secretariat is provided by the director general of the regional chamber of commerce and industry.
The commission may be assisted, for the tasks mentioned in 1° of I of article R. 713-14, by a representative of each company responsible for the routing of mail.
The administrative authority mentioned in II of article R. 713-1 sets up the commission no later than 15 September preceding the election.
