The data relating to voters registered on the electoral lists as well as those relating to the expression of the vote shall be the subject, in accordance with the procedures laid down by joint order of the Minister of Justice and the Minister responsible for overseeing the chambers of commerce and industry, issued after consulting the National Commission for Information Technology and Civil Liberties, of automated processing of information carried out on separate computer systems known as the “voters’ file” and the “contents of the electronic ballot box”.
The “voters’ file” processing operation is based on the electoral rolls drawn up by the electoral roll commission. The voters’ file enables the electoral organisation commission to send each voter the authentication instruments mentioned in article R. 713-54, to identify voters who have taken part in the electronic vote and to publish the list of votes cast. The tally indicates the time of the vote. The lists of voters’ names are recorded on a medium separate from that of the electronic ballot box, which is sealed and non-rewritable, so that its content cannot be altered and is probative.
The file known as the “contents of the electronic ballot box” records the votes cast electronically. The data in this file is encrypted and must not contain any link enabling voters to be identified.
