Article R7342-12 of the French Labour Code

Notification of the decision to approve the charter referred to in the first paragraph of Article L. 7342-10 shall indicate the time limit for appeal and the procedures for lodging an appeal. In the absence of this information, the time limit for appeal does not apply to the platform.

When the platform informs the worker of the decision to approve the charter, it shall at the same time inform him of the time limit for appeal and the procedures for lodging an appeal. In the absence of this information, the appeal period does not run in respect of the employee.

La notification de la décision d’homologation de la charte mentionnée au premier alinéa de l’article L. 7342-10 indique le délai de recours ainsi que les modalités selon lesquelles celui-ci peut être exercé. A défaut de ces mentions, le délai de recours ne court pas à l’égard de la plateforme.

Lorsque la plateforme porte à la connaissance du travailleur la décision d’homologation de la charte, elle l’informe, en même temps, du délai de recours ainsi que des modalités selon lesquelles celui-ci peut être exercé. A défaut de cette information, le délai de recours ne court pas à l’égard du travailleur.
