Article R742-17-1 of the French Commercial code

A person on the list of suitable candidates ceases to be entered on the list at his/her request, on the date of his/her appointment as a commercial court clerk or at the end of a period of five years.

An additional period of six months from entry on the list may be granted by the Keeper of the Seals, Minister of Justice, to persons who can demonstrate that they have a project in progress that is likely to lead to an appointment, in order to implement the project.
The Minister of Justice may grant an extension of six months for inclusion on the list to persons with a project in progress that is likely to lead to an appointment, in order to implement this project. The request for an extension must be made by tele-procedure on the website of the Ministry of Justice, no later than two months before the expiry of the five-year period referred to in the previous paragraph. The request must be accompanied by a copy of an identity document and any document proving the project.

Toute personne figurant sur la liste d’aptitude cesse d’y être inscrite à sa demande, à la date de sa nomination en qualité de greffier de tribunal de commerce ou à l’issue d’un délai de cinq ans.


Un délai supplémentaire de six mois d’inscription sur la liste peut être accordé par le garde des sceaux, ministre de la justice, aux personnes justifiant d’un projet en cours susceptible d’aboutir à une nomination, pour mettre en oeuvre ce projet. La demande de prolongation est adressée par téléprocédure sur le site internet du ministère de la justice, au plus tard deux mois avant l’expiration du délai de cinq ans mentionné à l’alinéa précédent. La demande est accompagnée de la copie d’une pièce d’identité et de tout document permettant de justifier du projet.
