Article R743-139-24 of the French Commercial code

The registration of the company in the Trade and Companies Register is governed by articles R. 123-31 and following, subject to the provisions below.

A copy of the declaration provided for in Article R. 743-139-23 is sent by the partners to the clerk’s office of the court where the application for registration in the Trade and Companies Register was filed; on receipt of this document, the clerk proceeds with the registration and informs the Minister of Justice and the Principal State Prosecutor of the Court of Appeal within whose jurisdiction the registered office of the company is located.

The company is exempt from the publication formalities provided for in articles R. 210-16 et seq.

L’immatriculation de la société au registre du commerce et des sociétés est régie par les articles R. 123-31 et suivants, sous réserve des dispositions ci-après.

Une copie de la déclaration prévue à l’article R. 743-139-23 est adressée par les associés au greffe du tribunal où a été déposée la demande d’immatriculation au registre du commerce et des sociétés ; au reçu de ce document, le greffier procède à l’immatriculation et en informe le garde des sceaux, ministre de la justice, ainsi que le procureur général près la cour d’appel dans le ressort de laquelle est fixé le siège de la société.

La société est dispensée de procéder aux formalités de publicité prévues aux articles R. 210-16 et suivants.
