In carrying out their duties, these magistrates have a general power of investigation, verification and control.

They may be assisted in carrying out inspections by any persons registered on the list of statutory auditors drawn up pursuant to article L. 822-1 as well as any expert or person of their choice. The costs incurred by this assistance are advanced by the National Council. They are recovered from the inspected professional if the latter is subject to a disciplinary sanction.

They may also be assisted by one or more court-appointed administrators and request the assistance of the State’s general inspectorates.

The inspected professional may ask another professional of his choice carrying out identical or similar missions to assist him during the inspection. He may also ask the statutory auditor who carried out the audit of his accounts pursuant to article R. 814-29 or a chartered accountant of his choice, to attend the inspection.

The hearing of a receiver or a person appointed under the conditions of the second paragraph of Article L. 811-2 by an inspecting magistrate shall give rise to the drawing up of a report signed by the interested party and the magistrate.

Pour l’exercice de leurs attributions, ces magistrats disposent d’un pouvoir général d’investigation, de vérification et de contrôle.

Ils peuvent se faire assister pour procéder aux inspections de toutes personnes inscrites sur la liste des commissaires aux comptes établie en application de l’article L. 822-1 ainsi que de tout expert ou toute personne de leur choix. Les frais occasionnés par cette assistance sont avancés par le Conseil national. Ils sont recouvrés sur le professionnel inspecté si celui-ci est l’objet d’une sanction disciplinaire.

Ils peuvent aussi se faire assister d’un ou plusieurs administrateurs judiciaires et solliciter le concours des inspections générales de l’Etat.

Le professionnel inspecté peut demander à un autre professionnel de son choix exerçant des missions identiques ou similaires, de l’assister lors de l’inspection. Il peut également demander au commissaire aux comptes ayant procédé à la vérification de sa comptabilité en application de l’article R. 814-29 ou à un expert-comptable de son choix, d’assister à l’inspection.

L’audition d’un administrateur judiciaire ou d’une personne désignée dans les conditions du deuxième alinéa de l’article L. 811-2 par un magistrat inspecteur donne lieu à l’établissement d’un procès-verbal signé par l’intéressé et le magistrat.
