In carrying out their duties, these magistrates have a general power of investigation, verification and control.
They may be assisted in carrying out inspections by any persons registered on the list of statutory auditors drawn up pursuant to article L. 822-1 as well as any expert or person of their choice. The costs incurred by this assistance are advanced by the National Council. They are recovered from the inspected professional if the latter is subject to a disciplinary sanction.
They may also be assisted by one or more court-appointed administrators and request the assistance of the State’s general inspectorates.
The inspected professional may ask another professional of his choice carrying out identical or similar missions to assist him during the inspection. He may also ask the statutory auditor who carried out the audit of his accounts pursuant to article R. 814-29 or a chartered accountant of his choice, to attend the inspection.
The hearing of a receiver or a person appointed under the conditions of the second paragraph of Article L. 811-2 by an inspecting magistrate shall give rise to the drawing up of a report signed by the interested party and the magistrate.
