Article R8115-7 of the French Labour Code

When a Labour Inspectorate monitoring officer observes one of the breaches of the declaration and information obligations mentioned in Articles R. 8293-1 to R. 8293-4, and R. 8295-3 committed by the employer of an employee or, where applicable, the user company of a temporary employee on secondment, he sends the Regional Director of Companies, Competition, Consumption, Labour and Employment a report on the basis of which the latter may decide to impose the administrative fine provided for in article L. 8291-2, in accordance with the procedures set out in articles R. 8115-2 to R. 8115-4.

Lorsqu’un agent de contrôle de l’inspection du travail constate l’un des manquements aux obligations de déclaration et d’information mentionnées aux articles R. 8293-1 à R. 8293-4, et R. 8295-3 commis par l’employeur d’un salarié ou le cas échéant de l’entreprise utilisatrice d’un salarié intérimaire détaché, il transmet au directeur régional des entreprises, de la concurrence, de la consommation, du travail et de l’emploi, un rapport sur le fondement duquel ce dernier peut décider de prononcer l’amende administrative prévue par l’article L. 8291-2, selon les modalités prévues aux articles R. 8115-2 à R. 8115-4.
