If the number of working hours normally required to carry out the work programme of the statutory auditor(s) appears to be excessive or insufficient, the president of the regional company shall be asked by the most diligent party to apply for a derogation from the numbers indicated in Article R. 823-12. This application must state the estimated number of hours required and the reasons for the exemption requested. It must be submitted before the assignment is carried out. The president of the regional company will give his decision within fifteen days of the request. This decision may be appealed to the chairman of the national company, which shall receive the appeal and give its ruling under the conditions set out in Article R. 823-18. The most diligent party has ten days from notification of the decision of the president of the regional company to refer the matter to the president of the national company, who will render his decision within one month from the date of referral. The decision of the president of the national company may be appealed to the restricted section of the Haut Conseil du Commissariat aux Comptes, which shall hear the case and give its ruling under the conditions laid down in Articles R. 823-18 paragraph 4 and R. 823-19 respectively.
This procedure does not apply if the parties agree to exceed the limits set in Articles R. 823-12 and R. 823-13.
