Book IIa: Combating eating disorders

The information campaigns referred to in article L. 3232-3 refer to non-commercial communications of a national nature, whatever the medium, the purpose of which is to present nutritional recommendations to the public as part of the prevention of obesity and overweight.

The initiators of the information campaigns defined in article D. 3232-1 send the Agence nationale de santé publique a file presenting their content under conditions set by order of the Minister for Health.

The Agence nationale de santé publique may approve campaigns whose applications are submitted to it, taking into account : 1° Their objectives, with regard to those mentioned in Article L. 1411-2; 2° Their messages, including those relating to the acceptance of obese or overweight people and the fight against any discrimination they may suffer, in the light of the recommendations and principles set out in the public health plans in…

Approval gives the campaign initiator the right to use the following wording on its communication media: “Obesity and overweight prevention campaign approved by the ANSP”. The list of campaigns approved by the ANSP is published on its website. Approval is granted for the duration of the campaign and, at most, for a period of two years. When it is made aware of the irregular use of the mention provided for in article D. 3232-4, the Agence nationale de santé publique may, after inviting the initiator of the campaign concerned to present its observations, order it to cease such use and, where appropriate, withdraw the approval initially granted.

Campaigns conducted by the Agence nationale de santé publique and the Agence nationale de sécurité sanitaire de l’alimentation, de l’environnement et du travail are not subject to the provisions of this chapter.

The form of presentation in addition to the nutrition declaration recommended in application of Article L. 3232-8 consists of a nutrition label complying with a set of specifications laid down by order of the ministers responsible for health, consumer affairs and agri-foodstuffs, after obtaining the opinion of the Agence nationale de sécurité sanitaire de l’alimentation, de l’environnement et du travail.
