Chapter II: Health and safety guarantees

No one may operate, either directly or through a third party, an establishment in which physical or sporting activities are practised if they have been convicted of an offence under article L. 212-9.

Establishments where one or more physical or sporting activities are practised must provide health and safety guarantees for each type of activity and establishment, as defined by regulation.

Any person shall be liable to one year’s imprisonment and a fine of 15,000 euros for any of the following offences: 1° (repealed) 2° Maintaining in operation an establishment where one or more physical or sporting activities are practised in disregard of a measure taken in application of article L. 322-5.

The administrative authority may oppose the opening or order the temporary or permanent closure of an establishment which does not provide the guarantees set out in articles L. 322-1 and L. 322-2 and does not meet the insurance obligations set out in article L. 321-7. Article L. 3335-4 of the French Public Health Code sets out the rules governing the sale and distribution of drinks in stadiums, physical education halls, gymnasiums and, more generally, in all physical activity and sports establishments.
