Chapter V: Transfer of sentenced persons

When, pursuant to an international convention or agreement, a person detained in execution of a sentence handed down by a foreign court is transferred to French territory to serve the part of the sentence remaining to be served there, the execution of the sentence is continued in accordance with the provisions of this code, and in particular this chapter.

On arrival on French soil, the detained offender is presented to the public prosecutor of the place of arrival, who conducts an identity examination and draws up a report. The sentence pronounced abroad is, by the effect of the international convention or agreement, directly and immediately enforceable on national territory for the part that remained to be served in the foreign State. However, where the penalty imposed is, by its nature or duration, more severe than the penalty provided for by French law for the same acts, the criminal court of the place of detention, seised by the public…

The court shall rule in open court, after hearing the public prosecutor, the convicted person and, where applicable, the lawyer chosen by him or appointed ex officio at his request. The judgment is immediately enforceable notwithstanding any appeal.

Transfer periods are deducted in full from the length of the sentence served in France. .

All contentious incidents relating to the enforcement of the custodial sentence remaining to be served in France shall be brought before the correctional court of the place of detention. The provisions of Article 711 of this Code shall apply.

The enforcement of the sentence shall be governed by the provisions of this Code.

No criminal proceedings may be instituted or continued and no sentence may be enforced in respect of the same acts against a convicted person who is serving in France, pursuant to an international convention or agreement, a custodial sentence handed down by a foreign court.
