Work equipment and means of protection put into service or used in establishments intended to receive workers are equipped, installed, used, adjusted and maintained in such a way as to protect the health and safety of workers, including in the event of changes to such work equipment and means of protection.
It is prohibited to put into service or use work equipment and means of protection which do not comply with the technical design rules set out in Chapter II and the certification procedures set out in Chapter III of Title I.
Notwithstanding the provisions of Article L. 4321-2, the use of new work equipment which does not comply with the provisions of Article L. 4311-1 is permitted for demonstration purposes only. For the application of the provisions of this Title, decrees of the Conseil d’Etat, issued after consultation with the professional organisations of employers and employees concerned, shall determine the organisational measures, conditions of implementation and technical requirements to which the use of work equipment and means of protection subject to the safety obligations defined in Article L. 4321-1 is subject.
The procedures for implementing the decrees of the Conseil d’Etat mentioned in article L. 4321-4 may be defined by conventions or agreements concluded between the administrative authority and representative national professional employers’ organisations.
