CHAPTER III : Financial provisions

Book III of this part is applicable to the communes of the overseas departments with the exception of the eighth paragraph (7°) of article L. 2331-2, the tenth paragraph (9°) of article L. 2331-8 and articles L. 2333-58 to L. 2333-63.

The proceeds of the increase in overseas France of the tax on air passenger transport provided for in Article L. 422-30 of the code of taxes on goods and services collected on boardings made in the region are allocated to the budget of the coastal municipalities set up as classified tourist resorts within the meaning of Article L. 133-13 of the Tourism Code, up to the fraction not allocated to…

The total amount of the lump-sum grant allocated to the municipalities of the overseas departments and territories and the territorial units of Mayotte and Saint-Pierre-et-Miquelon is increased in 1994 by a sum of 30 million francs, taken from the development grant instituted by article L. 2334-13. The distribution of this increase between the municipalities concerned is set by decree in the Conseil d’Etat.

The total amount of the flat-rate allowance for the municipalities in the overseas departments is increased in 2001 by a sum of 40 million francs, taken from the development allowance instituted in article L. 2334-13. This increase is distributed between the overseas departments in proportion to the population as defined in article L. 2334-2. In all communes where a first numbering operation is carried out, half of the cost of the operation, if completed before 31 December 2008, is subject to financial compensation in the form of an exceptional grant paid by the State.

In the overseas departments, the municipalities and public establishments for inter-municipal cooperation benefit from the global equipment grant under the conditions set by article L. 2334-33.

In the overseas departments, the population thresholds mentioned in 1° and 2° of article L. 2334-35 are set at 35,000 inhabitants.
