Chapter II: Public hospital service

The public hospital service performs all the tasks assigned to health care institutions by Chapter I of this Title, as well as providing emergency medical assistance, in compliance with the principles of equal access and care, continuity, adaptation and neutrality and in accordance with the obligations defined in article L. 6112-2.

I.-Health establishments providing the public hospital service and the health professionals working in them guarantee any person using their services: 1° An appropriate level of care, particularly when the person is disabled or in a precarious social situation, and a response time appropriate to their state of health ; 2° Permanent reception and care, in particular as part of the permanent care service organised by the competent regional health agency…

The public hospital service is provided by : 1° Public health establishments ; 2° Armed forces hospitals 3° Private health establishments authorised to provide the public hospital service and qualified as private health establishments of collective interest in application of article L. 6161-5 ; 4° Other private health establishments authorised, after a favourable opinion from the establishment’s medical conference, to provide the public hospital service. I.- When the Director General of the Regional Health Agency becomes aware of a breach of the obligations laid down in this chapter by an establishment providing a public hospital service, he will notify the legal representative of the establishment. The establishment will communicate its observations and the corrective measures taken or planned as part of an adversarial procedure, the procedures for which are laid down by the Conseil d’Etat…

Private health establishments other than those mentioned in 3° and 4° of article L. 6112-3 which are authorised to provide care to patients in emergency situations are associated with the public hospital service. Any patient treated in an emergency situation or as part of ongoing care in these establishments benefits from the guarantees provided for in I of article L. 6112-2 of the present code, including for consecutive care linked…

For the application of the rules governing the authorisations mentioned in chapter II of title II of this book, no account is taken of the fact that the establishment provides the public hospital service defined in article L. 6112-2 or that it is associated with it pursuant to article L. 6112-5.

The procedures for applying this chapter, in particular the procedures for submitting and examining applications for authorisation from private health establishments, are determined by decree in the Conseil d’Etat.
