Chapter IV: Building and civil engineering operations.

It is an offence for a project owner to have a building or part of a building built or converted for professional use without complying with the obligations imposed by the provisions of articles L. 112-2, L. 134-13 and L. 155-2 of the Code de la construction et de l’habitation, as well as by the regulatory provisions adopted for their application, is punishable by the penalties laid down in articles…

Failure by a project owner to send the administrative authority the prior declaration provided for in article L. 4532-1 is punishable by a fine of 4,500 euros.

Any project owner who opens a worksite that does not have roads and other networks that comply with the regulatory provisions of Chapter III of Title III of Book V of this Part is liable to a fine of 22,500 euros. Interruption of work may be ordered under the conditions set out in the article L. 480-2 du code de l’urbanisme.

The following is punishable by a fine of 10,000 euros for a project owner: 1° Failing to appoint a health and safety coordinator, in breach of Article L. 4532-4, or failing to provide the coordinator with the authority and resources required to carry out his duties, in breach of Article L. 4532-5 ; 2° Appointing a coordinator who does not meet the conditions defined by decree pursuant to Article L….

Failure by the contractor to submit to the project owner or coordinator the specific health and safety plan for workers provided for in article L. 4532-9 is punishable by a fine of 9,000 euros. A repeat offence is punishable by one year’s imprisonment and a fine of 15,000 euros. The court may also impose the penalties provided for in article L. 4741-5.

Failure by self-employed workers, or by employers when they are themselves working on a building or civil engineering site, to implement their obligations, under the legislative and regulatory provisions of Chapter V of Title III of Book V of this Part, is punishable by a fine of 4,500 euros.

In addition to the judicial police officers and labour inspection officers mentioned in article L. 8112-1, the offences defined in articles L. 4744-1 to L. 4744-5 are recorded by the persons provided for in article L. 480-1 of the town planning code.
