A jobseeker is anyone who is looking for work and applies to Pôle emploi to be registered on the list of jobseekers.
Jobseekers must periodically renew their registration in accordance with the procedures laid down by order of the Minister for Employment and the category in which they have been registered. They must also inform Pôle emploi of any changes in their situation that are likely to affect their registration as jobseekers.
Persons registered on the jobseekers’ list are classified in categories determined by order of the Minister for Employment on the basis of the purpose of their application and their availability for employment.
When a foreign person is registered on the list of jobseekers, Pôle emploi checks the validity of their residence and work permits. Pôle emploi may have access to the files of State services to obtain the information required for this verification, including when renewing residence and work permits, in order to ensure that the person concerned remains on the list of jobseekers. Disabled persons mentioned in 2° and 3° of article L. 341-4 of the Social Security Code, who receive a social benefit linked to total incapacity for work, may not be registered on the list of jobseekers for the duration of their incapacity.
Jobseekers who are immediately available for work are guided and supported in their job search by Pôle emploi. They are required to participate in defining and updating the personalised employment access project referred to in article L. 5411-6-1, to carry out positive and repeated acts of job-seeking and to accept reasonable offers of employment as defined in articles L. 5411-6-2 and L. 5411-6-3.
A personalised employment access project is drawn up and updated jointly by the jobseeker and Pôle emploi or, where provided for in an agreement with Pôle emploi, an organisation participating in the public employment service. The nature and characteristics of the job(s) sought, the preferred geographical area and the expected salary, as mentioned in the personalised project for access to employment, make up the reasonable job offer.
The personalised employment access project is updated periodically. When it is updated, the elements making up the reasonable job offer are revised, in particular to increase the prospects of a return to employment.
The provisions of this section and of 2° of Article L. 5412-1 may not oblige a jobseeker to accept: 1° A level of pay that is lower than the pay normally paid in the region and for the profession concerned, without prejudice to other legal provisions and contractual stipulations in force, in particular those relating to the minimum growth wage; 2° A part-time job, when the personalised project for access…
