Section 2: Legal regime for declarations of activity

Any person carrying out the actions provided for in article L. 6313-1 shall file a declaration of activity with the administrative authority as soon as the first vocational training agreement or the first vocational training contract is concluded, pursuant to articles L. 6353-1 and L. 6353-3 respectively. The administrative authority registers the declaration except in the cases provided for in article L. 6351-3.

The declaration of activity includes administrative information identifying the declarant, as well as descriptive information about the activity.

Registration of the declaration of activity may be refused, stating the reasons for refusal and indicating the appeal procedures, by decision of the administrative authority in the following cases: 1° The services provided under the first vocational training agreement or the first vocational training contract do not correspond to the actions mentioned in article L. 6313-1 ; 2° The provisions of Chapter III of this Title relating to the implementation…

The registration of the declaration of activity is cancelled by decision of the administrative authority when it is established, following an inspection carried out pursuant to 1° of Article L. 6361-2 : 1° Either that the services provided do not correspond to the actions mentioned in article L. 6313-1; 2° Or that one of the provisions of chapter III of this title relating to the provision of training has not…

An amending declaration is filed if one or more elements of the initial declaration are modified. A declaration is made when a business ceases.

The declaration of activity lapses if the educational and financial report provided for in article L. 6352-11 does not show any training activity, or if this report has not been sent to the administrative authority.

The Regional Council shall be notified of the details of the declaration of activity and any amendments thereto. It will be notified of the educational and financial report on the activity, the balance sheet, the profit and loss account and the notes to the accounts for the last financial year closed by the bodies whose training activities within the meaning of article L. 6313-1 benefit from its financial support.

The list of organisations declared under the conditions laid down in this chapter and up to date with their obligation to submit the educational and financial report referred to in article L. 6352-11 is made public and includes information relating to the organisation’s company name, its workforce, a description of the training courses provided and the number of employees and persons trained.

A decree in the Conseil d’Etat shall determine the terms and conditions for the application of this chapter.
