Subsection 4: Capital grants (R).

Equipment grants awarded by the State for operations undertaken by multi-purpose intercommunal syndicates, which meet the conditions set by article D. 5212-9, are increased by 20% without the total grant exceeding 80% of the amount of subsidisable expenditure.

The increase provided for in article D. 5212-8 applies to multi-purpose intercommunal syndicates whose revenue comes from contributions from the member communes, provided that these contributions are determined by applying criteria based exclusively on their respective financial capacity.

Multi-purpose intercommunal syndicates that do not meet the conditions defined in article D. 5212-9, may benefit from increased subsidies for their equipment operations insofar as these syndicates are of direct interest for intercommunal restructuring.

The right to an increase in the capital grant provided for in articles D. 5212-8 to D. 5212-10 is open for a period of five years from the date of creation of the syndicat de communes.

The increases in capital grants provided for in Articles D. 5212-8 to D. 5212-10 are awarded by the Prefect and charged to the appropriations delegated to him for this purpose by the Minister of the Interior.

The increase in the capital grant is the subject of a decision awarding the grant, which is notified to the public institution at the same time as the decision relating to the main grant.

The prefect shall set the rate of capital grant increases applicable to the operations provided for in Article D. 5212-10 and selected by him. This rate shall be between 5% and 15% of the amount of the main grant; the total of the increased grant shall not exceed 80% of the amount of the subsidisable expenditure.
