Chapter V: Economic, social, environmental and trade union training for employees called upon to perform trade union duties

The list of centres and institutes whose courses and sessions give entitlement to economic, social, environmental and trade union training leave is drawn up by order of the Minister for Labour, after consultation with the employee trade union organisations mentioned in 3° of article L. 2135-12.

At least thirty days before the start of the economic, social, environmental and trade union training leave, the employee sends the employer a request informing him of his wish to take advantage of this leave. The request must specify the date and duration of the absence requested and the name of the organisation responsible for the course or session.

The interested party is notified of the refusal of the economic, social, environmental and trade union training leave by the employer within eight days of receipt of the request. In the event of a dispute, the adjudication board of the industrial tribunal to which the matter has been referred in application of article L. 2145-11 will make the final decision, in accordance with the accelerated procedure on the merits.

The organisation responsible for the courses or sessions will issue the employee with a certificate confirming that he/she has actually attended the course. This certificate is given to the employer when the employee returns to work.
