Paragraph 1: Supervision of the operator of a physical activity or sports establishment

It is the responsibility of the administrative authority, when requesting the issue of bulletin no. 2 of the criminal record and the information contained in the automated national judicial file of perpetrators of sexual or violent offences, to ensure that the operator of an establishment mentioned in article L. 322-1 has not been convicted of a crime or one of the offences mentioned in article L. 212-9.

The administrative authority may oppose the opening or order the temporary or permanent closure of an establishment whose operator has refused to provide it with information enabling it to monitor the operator’s compliance with the guarantee provided for in article L. 322-1.
