A departmental commercial development commission rules on applications for authorisation submitted to it under the provisions of articles L. 752-1, L. 752-3 and L. 752-15.
I.-The departmental commercial development commission is chaired by the Prefect. For any new project, it interviews the person responsible for promoting town centre retailing on behalf of the municipality or the inter-municipal public cooperation establishment with its own tax system, the retail agency and the retailer associations in the municipality where the project is to be implemented and in neighbouring municipalities where these exist. Any member of the departmental commission for commercial development shall inform the prefect of the interests he holds and the position he holds in an economic activity. No member of the departmental commission may deliberate in a case in which he has a personal interest or if he represents or has represented one or more parties.
The conditions under which the members of the commission are appointed and the procedures for its operation are laid down by decree in the Conseil d’Etat.
The Commission nationale d’aménagement commercial (National Commission for Commercial Development) comprises twelve members appointed for a non-renewable term of six years by decree issued on the report of the Minister responsible for trade. The conditions for appointing the members of the national commission and its chairman, as well as the procedures for its operation, are laid down by decree in the Conseil d’Etat.
I. – Each year, the Commission nationale d’aménagement commercial publishes a report incorporating data relating to the activity of the departmental and national commissions. This report shall also include information relating to the knowledge of territories in commercial matters. II. – (Repealed)
