Section 3: Professional liability

I.-The traveller is entitled to an appropriate price reduction for any period of non-conformity of the services provided under a contract, unless the organiser or retailer proves that the non-conformity is attributable to the traveller. The travel or holiday organiser or retailer shall provide appropriate assistance to the traveller in difficulty as quickly as possible, taking into account the circumstances of the case, including in the circumstances mentioned in VII ofarticle L. 211-16.

The trader shall be liable for any errors due to technical faults in the booking system for which he is responsible and, if the trader has agreed to organise the booking of a holiday, he shall be liable for errors made during the booking process. A professional is not responsible for booking errors which are attributable to the traveller or which are caused by exceptional and unavoidable circumstances.

This section does not apply to 1° To services which do not form part of a tourist package and which relate either to air tickets or to other tickets for scheduled air travel ; 2° To services sold as part of a general agreement concluded for business travel.
