Section 2: Declaration and assessment of claims

Creditors lodge their claims in accordance with the conditions laid down by decree in the Conseil d’Etat; claims that have not been lodged within a period set by this decree are extinguished, unless the judge grants a discharge. Claims that have not been filed within a period set by decree in the Conseil d’Etat are extinguished, unless the judge grants a relief from the foreclosure.

The trustee draws up a balance sheet of the debtor’s economic and social situation, verifies the claims and assesses the assets and liabilities.

The judge shall rule on any disputed claims.
