Leave to validate experience may be requested with a view to: 1° Taking part in the assessment session organised by the ministry or certifying body; 2° Preparing for the validation.
The application for leave of absence to validate prior learning must specify: 1° The professional certification sought; 2° The dates, nature and duration of the actions enabling the employee to validate prior learning; 3° The name of the ministry or certifying body. The request for authorisation of absence shall be sent to the employer no later than sixty days before the start of the validation of acquired experience by any means that confers a date of receipt.
Within thirty calendar days of receipt of the request for leave, the employer shall notify the employee in writing of its agreement or of the service reasons for postponing the leave. This postponement may not exceed six months from the date of the request. If the employer does not reply within thirty calendar days of receiving the request for leave, this shall be deemed to be approval.
At the end of a leave of absence for the validation of prior learning, the beneficiary of the leave of absence must, at the request of the employer or of a funding body mentioned in article L. 6316-1, provide proof of his or her participation in the validation of prior learning provided by the ministry or certifying body and, where applicable, by the accompanying body.
An employee who has benefited from a leave of absence to carry out actions to validate acquired experience may not claim, in the same company, to benefit from a new leave of absence for the same purpose before one year, with the exception of candidates who have obtained one or more parts of the certification for the additional assessment provided for inarticle L. 335-5 of the Education Code.
The leave of absence is not taken into account when calculating the deductible period applicable to specific leave as part of a career transition project.
Leave for validation of prior learning takes place outside the period of performance of the fixed-term employment contract. It begins no later than twelve months after the end of the contract. By way of derogation, leave to validate experience may be taken, at the request of the employee and with the agreement of the employer, in whole or in part before the end of the employment contract.
