The parties to an administrative contract may have recourse to a third party conciliator or mediator, under the conditions laid down by the Chapters Iand II du titre II du livre IV du code des relations entre le public et l’administration.
The parties to a private law contract may have recourse to a third party conciliator or mediator, under the conditions laid down by the provisions of Chapter I of Title VI of Book I and Chapter II of Title I of Book V of the Code of Civil Procedure.
Referral to an advisory committee for the amicable settlement of disputes suspends the running of the various statutes of limitation, whatever the nature of the contract.
Referral to the Company Mediator suspends the running of the various statutes of limitation under the conditions set out in article L. 213-6 of the Code of Administrative Justice or, for contracts governed by private law, under the conditions set out in the Civil Code.
The parties may reach a settlement under article 2044 of the Civil Code.
Notwithstanding the provisions of the first paragraph of article 2060 of the Civil Code, recourse to arbitration for the settlement of disputes between public entities and their co-contractors in the performance of public contracts is possible for disputes relating to the financial performance of public works and supply contracts of the State, local authorities and local public establishments, as well as in other cases where the law permits.
Recourse to arbitration for the settlement of disputes between private parties in the performance of contracts is possible under the conditions defined by the Book IV of the code of civil procedure.
