Section 2: Admission

The Office français de l’immigration et de l’intégration will offer the asylum seeker a place to stay.This offer will take into account the needs, personal and family situation of each applicant in the light of the assessment of needs and vulnerability provided for in Chapter II of Title II, as well as the accommodation capacity available and the proportion of asylum seekers received in each region.

Decisions on admission to a place of accommodation for asylum seekers, as well as decisions to change the place, are taken by the French Office for Immigration and Integration, after consultation with the director of the place of accommodation, on the basis of the national reception plan for asylum seekers and, where applicable, the regional plan provided for in article L. 551-2 and taking into account the applicant’s situation.

The prefect or, in Paris, the police prefect, may object on grounds of public order to the decision to admit an asylum seeker to a place of accommodation. In this case, the Office français de l’immigration et de l’intégration is required to take a new decision on admission. The Office ensures that the people referred to the accommodation are present for the duration of the procedure. .

Without prejudice to article L. 345-2-2 of the Code de l’action sociale et des familles, in the event of refusal or abandonment of the accommodation offered in application of this chapter, the asylum seeker may not be accommodated in an establishment mentioned in 8° of I of article L. 312-1 or article L. 322-1 of the same code, nor benefit from the application of article L. 300-1 of the Code…

A foreign national who does not have stable accommodation and who expresses the wish to lodge an asylum application may be admitted to one of the accommodation facilities mentioned in 2° of article L. 552-1 before their asylum application is registered.Decisions on admission and exit are taken by the French Office for Immigration and Integration, taking account of the foreign national’s personal and family situation.
