Section 2: Detention of asylum seekers and transmission of their application to the French Office for the Protection of Refugees and Stateless Persons (OFPP)

When the foreign national submits his or her asylum application to the custodial authority, in accordance with Article R. 754-6, the custodial authority shall immediately inform the prefect who ordered the detention so that he or she can decide whether or not to keep the foreign national in detention in accordance with the first paragraph of Article L. 754-3.

The submission, investigation and judgment by the administrative courts of appeals for annulment lodged against the decisions to keep persons in detention referred to in the first paragraph of article L. 754-3 shall obey the rules defined in Chapter VII bis of Title VII of Book VII of the Code of Administrative Justice.
