Article 123-6 of the French Cinema and Moving Image Code

By decision of the Chairman of the Centre national du cinéma et de l’image animée, the sums entered in an automatic account may be carried over to another automatic account exclusively in the event of a complete takeover of the activity concerned by the holder of this other account.
As regards automatic financial aid for the production of audiovisual works and automatic financial aid for the promotion of cinematographic works abroad, the carry-over may relate to part of the sums entered in the automatic account in the event of a complete takeover of an autonomous branch of activity.
The assessment of the Chairman of the Centre national du cinéma et de l’image animée is based on the reality and completeness of the takeover of the business in the light, in particular, of the articles of association of the company taking over the business and the contractual documents between this company and the account holder stating the nature and conditions of the operation and mentioning all the items taken over attached to the business.
Where the company holding the automatic account is the subject of one of the procedures provided for in Book VI of the French Commercial Code, the Chairman of the Centre national du cinéma et de l’image animée will also take a decision in the light of the court decisions made in the context of these procedures.
The provisions of this article also apply where the beneficiary of the complete takeover of an activity or the complete takeover of an autonomous branch of activity is not yet the holder of an automatic account. In this case, an automatic account will be opened in the beneficiary’s name to which the corresponding sums will be transferred.

Sur décision du président du Centre national du cinéma et de l’image animée, les sommes inscrites sur un compte automatique peuvent être reportées sur un autre compte automatique exclusivement dans le cas d’une reprise complète de l’activité concernée par le titulaire de cet autre compte.
En ce qui concerne les aides financières automatiques à la production d’œuvres audiovisuelles et les aides financières automatiques à la promotion à l’étranger des œuvres cinématographiques, le report peut porter sur une partie des sommes inscrites sur le compte automatique en cas de reprise complète d’une branche autonome d’activité.
L’appréciation du président du Centre national du cinéma et de l’image animée porte sur la réalité et le caractère complet de la reprise d’activité au regard, notamment, des statuts de l’entreprise qui reprend l’activité et des documents contractuels entre cette entreprise et le titulaire du compte faisant état de la nature et des conditions de l’opération et mentionnant l’ensemble des éléments repris attachés à l’activité.
Lorsque l’entreprise titulaire du compte automatique fait l’objet de l’une des procédures prévues au Livre VI du code de commerce, le président du Centre national du cinéma et de l’image animée se prononce également au vu des décisions de justice intervenues dans le cadre de cette procédure.
Les dispositions du présent article s’appliquent également lorsque le bénéficiaire de la reprise complète d’activité ou de la reprise complète d’une branche autonome d’activité n’est pas encore titulaire d’un compte automatique. Dans ce cas, il est procédé à l’ouverture d’un compte automatique à son nom sur lequel sont reportées les sommes correspondantes.
