Article 384 of the French Code of civil procedure

Except in cases where this effect results from the judgment, proceedings are extinguished incidentally to the action by the effect of a settlement, acquiescence, discontinuance of the action or, in non-transferable actions, by the death of a party.

The termination of the proceedings is recorded by a decision to relinquish jurisdiction.

It is for the judge to give enforceability to the deed recording the agreement of the parties, whether it takes place before him or was concluded outside his presence.

En dehors des cas où cet effet résulte du jugement, l’instance s’éteint accessoirement à l’action par l’effet de la transaction, de l’acquiescement, du désistement d’action ou, dans les actions non transmissibles, par le décès d’une partie.

L’extinction de l’instance est constatée par une décision de dessaisissement.

Il appartient au juge de donner force exécutoire à l’acte constatant l’accord des parties, que celui-ci intervienne devant lui ou ait été conclu hors sa présence.
