Article 394 of the French Customs Code

The master is relieved of all liability :

a) in the case of an offence referred to in article 424,2°, below, if he proves that he has fulfilled all his supervisory duties or if the offender is discovered ;

b) in the case of an offence referred to in article 424,3°, below, if he can prove that serious damage required the ship to be diverted and on condition that these events were recorded in the logbook before the visit by the customs service.

Le capitaine est déchargé de toute responsabilité :

a) dans le cas d’infraction visé à l’article 424,2°, ci-après, s’il administre la preuve qu’il a rempli tous ses devoirs de surveillance ou si le délinquant est découvert ;

b) dans le cas d’infraction visé à l’article 424,3°, ci-après, s’il justifie que des avaries sérieuses ont nécessité le déroutement du navire et à condition que ces événements aient été consignés au journal de bord avant la visite du service des douanes.
