Article 397 of the French Civil Code

The family council rules on impediments, withdrawals and replacements that concern the tutor and subrogated tutor.

The guardianship judge rules on those that concern the other members of the family council.

A tutelary office may only be withdrawn, by the person who entrusted it, after the holder has been heard or called.

The judge may, if he considers that there is an emergency, prescribe provisional measures in the interest of the minor.

Le conseil de famille statue sur les empêchements, les retraits et les remplacements qui intéressent le tuteur et le subrogé tuteur.

Le juge des tutelles statue sur ceux qui intéressent les autres membres du conseil de famille.

Une charge tutélaire ne peut être retirée, par celui qui l’a confiée, qu’après que son titulaire a été entendu ou appelé.

Le juge peut, s’il estime qu’il y a urgence, prescrire des mesures provisoires dans l’intérêt du mineur.
