Article 399 of the French Civil Code

The guardianship judge appoints the members of the family council for the duration of the guardianship.

The family council is made up of at least four members, including the guardian and the subrogated guardian, but not the judge.

Members of the family council may include the parents and relatives of the minor’s father and mother and any person, resident in France or abroad, who shows an interest in the minor.

The members of the family council are chosen in consideration of the minor’s interests and on the basis of their suitability, the usual relations they had with the minor’s father or mother, the emotional ties they have with the minor and the availability they show.

The judge must avoid, as far as possible, leaving one of the two branches, paternal or maternal, unrepresented.

Le juge des tutelles désigne les membres du conseil de famille pour la durée de la tutelle.

Le conseil de famille est composé d’au moins quatre membres, y compris le tuteur et le subrogé tuteur, mais non le juge.

Peuvent être membres du conseil de famille les parents et alliés des père et mère du mineur ainsi que toute personne, résidant en France ou à l’étranger, qui manifeste un intérêt pour lui.

Les membres du conseil de famille sont choisis en considération de l’intérêt du mineur et en fonction de leur aptitude, des relations habituelles qu’ils entretenaient avec le père ou la mère de celui-ci, des liens affectifs qu’ils ont avec lui ainsi que de la disponibilité qu’ils présentent.

Le juge doit éviter, dans la mesure du possible, de laisser l’une des deux branches, paternelle ou maternelle, sans représentation.
