Article 411-46 of the French Cinema and Moving Image Code

Each of the points awarded is weighted according to the following coefficients:
I. – Weighting for duration:
1° Each point on the scale is weighted by a multiplier of 1 for a work lasting less than 20 minutes;
2° Each point on the scale is weighted by a multiplier of 1.5 for a work lasting between 20 and 29 minutes;
3° Each point on the scale is weighted by a multiplier of 2.5 for a work lasting between 30 and 60 minutes.
II. – Weighting due to co-production:
1° In the case of a national co-production, each of the points on the scale corresponding to the co-produced work is weighted by a multiplying factor calculated in proportion to the co-production share of the company;
2° In the case of an international co-production:
a) Where the French participation is less than 50%, each of the points in the scale corresponding to the co-produced work is weighted by a multiplying coefficient calculated in proportion to the co-production share of the company;
b) Where the French participation is equal to or greater than 50%:

– when the audiovisual production contract with the writer-director has been concluded with a production company established in France: there is no weighting;
– when the audiovisual production contract with the writer-director has been concluded with a production company established abroad: each of the points in the scale corresponding to the co-produced work is weighted by a multiplying coefficient calculated in proportion to the co-production share of the company.

III. – Weighting according to the nature of the works:
1° Each scale point corresponding to works produced by the same production company as part of a series is weighted by a multiplying factor of 0.3;
2° Each scale point corresponding to episodes of audiovisual series is weighted by a multiplying factor of 0.

Article 411-46

Chacun des points attribués est pondéré en fonction des coefficients suivants :
I. – Pondération en raison de la durée :
1° Chaque point du barème est pondéré par un coefficient multiplicateur de 1 pour une œuvre d’une durée inférieure à 20 minutes ;
2° Chaque point du barème est pondéré par un coefficient multiplicateur de 1,5 pour une œuvre d’une durée comprise entre 20 à 29 minutes ;
3° Chaque point du barème est pondéré par un coefficient multiplicateur de 2,5 pour une œuvre d’une durée comprise entre 30 et 60 minutes.
II. – Pondération en raison d’une coproduction :
1° Dans le cas d’une coproduction nationale, chacun des points du barème correspondant à l’œuvre coproduite est pondéré par un coefficient multiplicateur calculé au prorata de la part de coproduction de l’entreprise ;
2° Dans le cas d’une coproduction internationale :
a) Lorsque la participation française est inférieure à 50 %, chacun des points du barème correspondant à l’œuvre coproduite est pondéré par un coefficient multiplicateur calculé au prorata de la part de coproduction de l’entreprise ;
b) Lorsque la participation française est supérieure ou égale à 50 % :

– lorsque le contrat de production audiovisuelle avec l’auteur-réalisateur a été conclu avec une entreprise de production établie en France : il n’y a aucune pondération ;
– lorsque le contrat de production audiovisuelle avec l’auteur-réalisateur a été conclu avec une entreprise de production établie à l’étranger : chacun des points du barème correspondant à l’œuvre coproduite est pondéré par un coefficient multiplicateur calculé au prorata de la part de coproduction de l’entreprise.

III. – Pondération en raison de la nature des œuvres :
1° Chaque point du barème correspondant à des œuvres produites par la même entreprise de production dans le cadre d’une collection est pondéré par un coefficient multiplicateur de 0,3 ;
2° Chaque point du barème correspondant à des épisodes de séries audiovisuelles est pondéré par un coefficient multiplicateur de 0.
