There are one or more investigating judges in each département.

Where there are several judicial courts in a department, a decree may determine the list of courts in which there is no investigating judge. This decree specifies the judicial court whose investigating judge or judges are competent to hear information concerning offences falling within the scope of Article 43, of the jurisdiction of the public prosecutor of the court in which there is no investigating judge.

In some judicial courts, investigating judges are grouped together in an investigating division.

Investigating judges forming an investigating division have sole jurisdiction to hear information giving rise to a co-investigation under the conditions set out in Articles 83-1 and 83-2.

They also have exclusive jurisdiction over information relating to crimes and remain so in the event of a change in the nature of the facts during the course of the investigation or its resolution. However, in the case of a crime punishable by fifteen years’ or twenty years’ imprisonment, where it has not been committed as a repeat offence, and if the public prosecutor considers that it results from the circumstances of the case and its lack of complexity that recourse to co-investigation, even in the course of the investigation, seems unlikely, he may request that the investigation be opened with the investigating judge of the judicial court in which there is no investigating division.

The list of courts in which there is an investigating division and the territorial jurisdiction of the investigating judges who make up the division are determined by decree. This jurisdiction may cover the jurisdiction of several judicial courts. One or more investigating judges may be appointed, taking into account any specialisations provided for by articles 704,706-2,706-17,706-75-1 and 706-107, to coordinate the work of the investigating judges within the division, in accordance with the conditions laid down by decree.

Il y a un ou plusieurs juges d’instruction dans chaque département.

Lorsqu’il existe plusieurs tribunaux judiciaires dans un département, un décret peut fixer la liste des tribunaux dans lesquels il n’y a pas de juge d’instruction. Ce décret précise quel est le tribunal judiciaire dont le ou les juges d’instruction sont compétents pour connaître des informations concernant des infractions relevant, en application de l’article 43, de la compétence du procureur de la République du tribunal dans lequel il n’y a pas de juge d’instruction.

Dans certains tribunaux judiciaires, les juges d’instruction sont regroupés au sein d’un pôle de l’instruction.

Les juges d’instruction composant un pôle de l’instruction sont seuls compétents pour connaître des informations donnant lieu à une cosaisine dans les conditions prévues aux articles 83-1 et 83-2.

Ils sont également seuls compétents pour connaître des informations en matière de crime et le demeurent en cas de requalification des faits au cours de l’information ou lors du règlement de celle-ci. Toutefois, s’il s’agit d’un crime puni de quinze ans ou de vingt ans de réclusion criminelle, lorsqu’il n’est pas commis en état de récidive légale et si le procureur de la République considère qu’il résulte des circonstances de l’espèce et de son absence de complexité que le recours à la cosaisine, même en cours d’instruction, paraît peu probable, il peut requérir l’ouverture de l’information auprès du juge d’instruction du tribunal judiciaire dans lequel il n’y a pas de pôle de l’instruction.

La liste des tribunaux dans lesquels existe un pôle de l’instruction et la compétence territoriale des juges d’instruction qui le composent sont déterminées par décret. Cette compétence peut recouvrir le ressort de plusieurs tribunaux judiciaires. Un ou plusieurs juges d’instruction peuvent être chargés, en tenant compte s’il y a lieu des spécialisations prévues par les articles 704,706-2,706-17,706-75-1 et 706-107, de coordonner l’activité des juges d’instruction au sein du pôle, dans des conditions fixées par décret.
