Article 611-18 of the French Cinema and Moving Image Code

The videogram publisher is required to repay the sums invested in the following cases:
1° For long-form cinematographic works:
a) When investment approval has been granted and the cinematographic work does not give rise to the granting of production approval;
b) When the work does not meet the conditions set out in articles 211-7 to 211-13 ;
c) Where the production has not been edited within two years of production approval being granted;
2° For short films :
a) When no production aid has been granted;
b) When the editing has not been carried out within three years of the cinematographic exhibition approval being issued;
3° For heritage cinematographic works:
a) When the work does not meet the eligibility conditions set out in Article 511-4;
b) Where the edition has not been made and marketed within two years of the investment authorisation being issued.

Article 611-18

L’éditeur de vidéogrammes est tenu de reverser les sommes investies dans les cas suivants :
1° Pour les œuvres cinématographiques de longue durée :
a) Lorsque l’agrément des investissements a été délivré et que l’œuvre cinématographique ne donne pas lieu à la délivrance de l’agrément de production ;
b) Lorsque l’œuvre ne répond pas aux conditions prévues aux articles 211-7 à 211-13 ;
c) Lorsque l’édition n’a pas été effectuée dans les deux ans suivant la délivrance de l’agrément de production ;
2° Pour les œuvres cinématographiques de courte durée :
a) Lorsqu’aucune aide à la production n’a été attribuée ;
b) Lorsque l’édition n’a pas été effectuée dans les trois ans suivant la délivrance du visa d’exploitation cinématographique ;
3° Pour les œuvres cinématographiques du patrimoine :
a) Lorsque l’œuvre ne répond pas aux conditions d’éligibilité prévues à l’article 511-4 ;
b) Lorsque l’édition n’a pas été effectuée et commercialisée dans les deux ans suivant la délivrance de l’autorisation d’investissement.
