Automatic financial support for the video production of cinematographic and audiovisual works involves the allocation of investment grants and direct grants.
The sums representing the automatic financial aid to which videogram publishers are entitled are calculated by applying a rate to the amount of turnover declared by them for each feature film for which production approval has been granted.
The calculation rate is set at 4.5%.
Videogram publishers declare their turnover each month and, where applicable, provide any supporting documents.Turnover refers to the amount, excluding value added tax, of all sums, values, goods or services received by videogram publishers in return for the sale and rental of videograms of the cinematographic works concerned.The declaration is made within six months of the last day of the month in question. The sums are calculated for a period of six years from the first commercial showing of the work in cinemas, subject to the provisions relating to the control of cinematographic exhibition revenues set out in 3° of article L. 212-32 of the Code du cinéma et de l’image animée.
Sums held in the automatic video publishing account may be invested: 1° To acquire the video publishing rights to long-term cinematographic works that meet the conditions set out in articles 211-7 to 211-13. The sums entered in the automatic video publishing account may also be invested to cover the following publishing expenses, relating to cinematographic works mentioned in article 611-14 : 1° Expenditure on the manufacture of media; 2° Technical expenditure, including expenditure on making works secure and accessible to people with disabilities; 3° Editorial expenditure; 4° Promotion and marketing expenditure; 5° Expenditure on subtitling and dubbing.
Videogram publishers have the option of investing the sums entered in their automatic video publishing account in order to contribute to the online distribution of cinematographic works under the conditions set out in chapter II of this title, when they also have an automatic online distribution account.
The investment of sums registered in its automatic video publishing account by a videogram publisher is subject to the issue of an investment authorisation.
The videogram publisher is required to repay the sums invested in the following cases: 1° For long-form cinematographic works: a) When investment approval has been granted and the cinematographic work does not give rise to the granting of production approval; b) When the work does not meet the conditions set out in articles 211-7 to 211-13 ; c) Where the production has not been edited within two years of production…
