Article 698 of the French Code of Criminal Procedure

The offences falling within the jurisdiction of the courts mentioned in articles 697 and 697-4 are prosecuted, investigated and judged according to the rules of this code, subject to the specific provisions of articles 698-1 to 698-9 and, with regard to offences committed outside the territory of the Republic, the specific provisions of the code of military justice.

However, the competent public prosecutor pursuant to Article 43 has the authority to carry out or cause to be carried out acts required by the urgency and to request the investigating judge of his seat for this purpose. The provisions of articles 698-1 to 698-5 shall then apply.

Les infractions relevant de la compétence des juridictions mentionnées aux articles 697 et 697-4 sont poursuivies, instruites et jugées selon les règles du présent code, sous réserve des dispositions particulières des articles 698-1 à 698-9 et, s’agissant des infractions commises hors du territoire de la République, des dispositions particulières du code de justice militaire.

Toutefois, le procureur de la République compétent en application de l’article 43 a qualité pour accomplir ou faire accomplir les actes nécessités par l’urgence et requérir à cet effet le juge d’instruction de son siège. Les dispositions des articles 698-1 à 698-5 sont alors applicables.
