Article 712-13 of the French Code of Criminal Procedure

An appeal against the judgments referred to in the articles 712-6 and 712-7 is brought before the Enforcement of Sentences Chamber of the Court of Appeal, which rules in a reasoned judgment after an adversarial debate during which the prosecution’s case and the sentenced person’s lawyer’s observations are heard. The sentenced person is not heard by the chamber, unless it decides otherwise. His or her hearing is then held, in the presence of his or her lawyer or the latter duly summoned, either in accordance with the procedures provided for by Article 706-71, or, by a member of the court, in the prison where he or she is being held.

For the review of appeals against judgments referred to in article 712-7, the enforcement chamber of the court of appeal shall be composed, in addition to the president and the two assessor councillors, of a manager from an association for the reintegration of convicted persons and a manager from a victim support association. For the application of the provisions of this paragraph, the jurisdiction of a court of appeal may be extended to the jurisdiction of several courts of appeal by a decree which determines the list and jurisdiction of these courts.

If it upholds a judgment refusing to grant one of the measures referred to in articles 712-6 or 712-7, the Chamber may set a time limit during which any new application for the granting of the same measure will be inadmissible. This period may not exceed one third of the time remaining to be served or three years.

L’appel des jugements mentionnés aux articles 712-6 et 712-7 est porté devant la chambre de l’application des peines de la cour d’appel, qui statue par arrêt motivé après un débat contradictoire au cours duquel sont entendues les réquisitions du ministère public et les observations de l’avocat du condamné. Le condamné n’est pas entendu par la chambre, sauf si celle-ci en décide autrement. Son audition est alors effectuée, en présence de son avocat ou celui-ci régulièrement convoqué, soit selon les modalités prévues par l’article 706-71, soit, par un membre de la juridiction, dans l’établissement pénitentiaire où il se trouve détenu.

Pour l’examen de l’appel des jugements mentionnés à l’article 712-7, la chambre de l’application des peines de la cour d’appel est composée, outre le président et les deux conseillers assesseurs, d’un responsable d’une association de réinsertion des condamnés et d’un responsable d’une association d’aide aux victimes. Pour l’application des dispositions du présent alinéa, la compétence d’une cour d’appel peut être étendue au ressort de plusieurs cours d’appel par un décret qui fixe la liste et le ressort de ces juridictions.

Si elle confirme un jugement ayant refusé d’accorder une des mesures mentionnées aux articles 712-6 ou 712-7, la chambre peut fixer un délai pendant lequel toute nouvelle demande tendant à l’octroi de la même mesure sera irrecevable. Ce délai ne peut excéder ni le tiers du temps de détention restant à subir ni trois années.
