Article 713-1 of the French Code of Criminal Procedure

Confiscation orders which may give rise to transmission to or enforcement in another State are those which confiscate property, movable or immovable, tangible or intangible, as well as any legal instrument or document evidencing title to or interest in such property, on the grounds:

1° That they constitute the instrument or object of an offence;

2° That they constitute the proceeds of an offence or correspond in whole or in part to the value of such proceeds;

3° That they are liable to confiscation under any other provision of the law of the issuing State even though they are not the instrument, object or proceeds of the offence.

Article 713-1
Les décisions de confiscation qui peuvent donner lieu à la transmission ou à l’exécution dans un autre Etat sont celles qui confisquent des biens, meubles ou immeubles, corporels ou incorporels, ainsi que tout acte juridique ou document attestant d’un titre ou d’un droit sur ce bien, au motif :


1° Qu’ils constituent l’instrument ou l’objet d’une infraction ;


2° Qu’ils constituent le produit d’une infraction ou correspondent en tout ou en partie à la valeur de ce produit ;


3° Qu’ils sont passibles de confiscation en application de toute autre disposition de la législation de l’Etat d’émission bien qu’ils ne soient pas l’instrument, l’objet ou le produit de l’infraction.
