Article 713 of the French Code of Criminal Procedure

A confiscation order is a final penalty or measure ordered by a court in a Member State of the European Union, referred to as the issuing State, following proceedings in respect of one or more criminal offences, resulting in the permanent deprivation of one or more items of property.

The judicial authority shall be competent, in accordance with the rules and conditions laid down in this section, to transmit to the competent authorities of the other Member States of the European Union, known as the executing States, or to execute, at their request, an order to confiscate property.

Article 713

Une décision de confiscation est une peine ou une mesure définitive ordonnée par une juridiction d’un Etat membre de l’Union européenne, appelé Etat d’émission, à la suite d’une procédure portant sur une ou plusieurs infractions pénales, aboutissant à la privation permanente d’un ou plusieurs biens.

L’autorité judiciaire est compétente, selon les règles et dans les conditions déterminées par la présente section, pour transmettre aux autorités compétentes des autres Etats membres de l’Union européenne, appelés Etats d’exécution, ou pour exécuter, sur leur demande, une décision de confiscation de biens.
