By way of derogation from the first paragraph of Article 720-4 of this Code, where the Assize Court has decided, pursuant to Article 421-7 of the Criminal Code, to increase the security period to thirty years or that none of the measures listed in Article 132-23 of the same code could not be granted to a person sentenced to life imprisonment, the sentence enforcement court, on the advice of a commission of five judges from the Court of Cassation responsible for assessing whether there are grounds for terminating the application of the said decision of the Assize Court, may only reduce the length of the security period, exceptionally and under the conditions provided for in Article 712-7 of this code :
<1° That after the sentenced person has been imprisoned for a period of at least thirty years;
2° That when the sentenced person shows serious signs of social rehabilitation;
3° That when the reduction of the security period is not likely to cause a serious disturbance to public order;
4° That after having obtained the opinion of the victims having the status of civil parties at the time of the sentencing decision;
5° That after expert appraisal by a panel of three medical experts on the list of experts approved by the Court of Cassation, responsible for making an assessment of the dangerousness of the convicted person;
The members of the commission referred to in the first paragraph of this article are appointed by the general assembly of the Court of Cassation; one of them, chosen from among the members of the criminal chamber, chairs it.
By way of derogation from the penultimate paragraph of Article 732 of this Code, the Sentence Enforcement Court may order assistance, supervision and control measures with no time limit.
