Article 723-16 of the French Code of Criminal Procedure

By way of derogation from the provisions of article 723-15, in the event of an emergency motivated either by a risk of danger to persons or property established by the occurrence of a new fact, or by the incarceration of the person in the context of other proceedings, or a proven risk of the sentenced person absconding, the public prosecutor may enforce the sentence in a prison establishment.

It shall immediately inform the sentence enforcement judge if the matter has been referred to the latter pursuant to the second paragraph of article 723-15.

Article 723-16

Par dérogation aux dispositions de l’article 723-15, en cas d’urgence motivée soit par un risque de danger pour les personnes ou les biens établi par la survenance d’un fait nouveau, soit par l’incarcération de la personne dans le cadre d’une autre procédure, soit d’un risque avéré de fuite du condamné, le ministère public peut mettre la peine à exécution en établissement pénitentiaire.

Il en informe immédiatement le juge de l’application des peines si celui-ci a été saisi en application du deuxième alinéa de l’article 723-15.
