Article 728-10 of the French Code of Criminal Procedure

This chapter lays down the rules applicable, with a view to facilitating the social rehabilitation of sentenced persons, to the recognition and enforcement, in a Member State of the European Union, of final criminal sentences involving deprivation of liberty or a detention order handed down by the French courts and to the recognition and enforcement in France of such sentences handed down by the courts of another Member State.

The State in whose territory the decision was handed down is known as the sentencing State. The State which is requested to enforce the decision on its territory is called the enforcing State.

Le présent chapitre détermine les règles applicables, en vue de faciliter la réinsertion sociale de la personne condamnée, à la reconnaissance et à l’exécution, dans un Etat membre de l’Union européenne, des condamnations pénales définitives à une peine ou à une mesure de sûreté privative de liberté prononcées par les juridictions françaises ainsi qu’à la reconnaissance et à l’exécution en France de telles condamnations prononcées par les juridictions d’un autre Etat membre.


L’Etat sur le territoire duquel a été prononcée la décision est appelé Etat de condamnation. L’Etat auquel est demandée l’exécution de cette décision sur son territoire est appelé Etat d’exécution.
