Article 763-5 of the French Code of Criminal Procedure

In the event of failure to comply with the obligations mentioned in the articles 131-36-2 and 131-36-3 of the Penal Code or the injunction to provide care, the sentence enforcement judge may, of his own motion or at the request of the public prosecutor, order, in a reasoned decision, the enforcement of the prison sentence imposed by the trial court pursuant to the third paragraph of Article 131-36-1 of the Criminal Code. This decision is taken in accordance with the provisions set out in article 712-6.

In the event of non-compliance with the obligations or the care injunction, the provisions of Article 712-17 shall apply.

If the convicted person refuses to start or continue the treatment prescribed by the treating doctor and offered to him or her as part of a care order, this constitutes a breach of the obligations imposed on him or her.

Completion of imprisonment for non-compliance with the obligations of socio-judicial supervision does not exempt the convicted person from the execution of socio-judicial supervision. In the event of further failure by the convicted offender to comply with his obligations, the sentence enforcement judge may again order the enforcement of imprisonment for a period which, together with the period of imprisonment served, may not exceed that set by the sentencing court.

En cas d’inobservation des obligations mentionnées aux articles 131-36-2 et 131-36-3 du code pénal ou de l’injonction de soins, le juge de l’application des peines peut, d’office ou sur réquisitions du procureur de la République, ordonner, par décision motivée, la mise à exécution de l’emprisonnement prononcé par la juridiction de jugement en application du troisième alinéa de l’article 131-36-1 du code pénal. Cette décision est prise selon les dispositions prévues à l’article 712-6.

En cas d’inobservation des obligations ou de l’injonction de soins, les dispositions de l’article 712-17 sont applicables.

Constitue pour le condamné une violation des obligations qui lui ont été imposées le fait de refuser de commencer ou de poursuivre le traitement prescrit par le médecin traitant et qui lui a été proposé dans le cadre d’une injonction de soins.

L’accomplissement de l’emprisonnement pour inobservation des obligations du suivi socio-judiciaire ne dispense pas le condamné de l’exécution du suivi socio-judiciaire. En cas de nouveau manquement par le condamné à ses obligations, le juge de l’application des peines peut de nouveau ordonner la mise à exécution de l’emprisonnement pour une durée qui, cumulée avec la durée de l’emprisonnement exécuté, ne saurait excéder celle fixée par la juridiction de condamnation.
