In the event of failure to comply with the obligations mentioned in the articles 131-36-2 and 131-36-3 of the Penal Code or the injunction to provide care, the sentence enforcement judge may, of his own motion or at the request of the public prosecutor, order, in a reasoned decision, the enforcement of the prison sentence imposed by the trial court pursuant to the third paragraph of Article 131-36-1 of the Criminal Code. This decision is taken in accordance with the provisions set out in article 712-6.
In the event of non-compliance with the obligations or the care injunction, the provisions of Article 712-17 shall apply.
If the convicted person refuses to start or continue the treatment prescribed by the treating doctor and offered to him or her as part of a care order, this constitutes a breach of the obligations imposed on him or her.
Completion of imprisonment for non-compliance with the obligations of socio-judicial supervision does not exempt the convicted person from the execution of socio-judicial supervision. In the event of further failure by the convicted offender to comply with his obligations, the sentence enforcement judge may again order the enforcement of imprisonment for a period which, together with the period of imprisonment served, may not exceed that set by the sentencing court.
